Acceptance of Terms

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and Play Jump Private Limited, a company incorporated under the Companies Act, 2013, bearing Corporate Identification Number (CIN) U73200UP2025PTC239240, with its registered office at Office 315, 3rd Floor, Ocean Complex, Sector 18, Noida, Uttar Pradesh 201301, India ("Play Jump", "Company", "we", "us", "our").

By accessing, browsing, registering on, or otherwise using the Play Jump website, mobile application, or any associated digital platform (collectively, the "Platform"), you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to any part of these Terms, you must immediately discontinue use of the Platform.

These Terms should be read together with our Privacy Policy, Refund Policy, and any other rules, guidelines, or policies published on the Platform, all of which are incorporated herein by reference. In case of any conflict between these Terms and any supplementary policy, these Terms shall prevail unless otherwise stated.

Definitions & Interpretation

For the purpose of these Terms, the following words and expressions shall have the meanings assigned to them below unless the context requires otherwise:

• "Account" means the registered user profile created on the Platform by providing relevant personal information and credentials.
• "Content" means all text, images, graphics, audio, video, software code, game assets, data, and any other materials available on or through the Platform.
• "Intellectual Property Rights" means all patents, copyrights, trademarks, trade secrets, design rights, database rights, and any other proprietary rights, whether registered or unregistered.
• "Platform Services" means the online gaming, mobile entertainment, analytics, secure transaction processing, cloud infrastructure, and B2B partnership services offered by Play Jump.
• "Transaction" means any financial exchange including deposits, withdrawals, in-platform purchases, subscriptions, or fee payments conducted through the Platform.
• "Third-Party Services" means services, software, tools, or platforms provided by parties other than Play Jump that may be integrated into or linked from the Platform.
• "Force Majeure Event" means any event beyond the reasonable control of Play Jump, including natural disasters, government actions, cyberattacks, power failures, or any other unforeseen circumstances.
• "Prohibited Content" means any Content that is unlawful, harmful, abusive, defamatory, obscene, fraudulent, or otherwise objectionable as described in these Terms.
• "User Data" means personal information, usage data, behavioural data, and any other data generated or submitted by you while using the Platform.

References to the singular include the plural and vice versa. Headings are for convenience only and shall not affect the interpretation of these Terms. Any reference to a statute includes all amendments and re-enactments thereof.

User Eligibility

Access to and use of the Platform is subject to the following eligibility requirements. By using the Platform, you represent and warrant that you meet all of the following criteria:

Age Requirement

You must be at least eighteen (18) years of age to create an Account or use any Platform Services. By registering, you affirm that you are of legal age and that all information you provide is accurate and truthful. Play Jump reserves the right to terminate any account found to belong to a minor and to discard any transactions associated with such an account.

Legal Capacity

You must have the full legal capacity to enter into a binding contract under the Indian Contract Act, 1872, and all other applicable laws. Persons of unsound mind, undischarged insolvents, or those otherwise legally disqualified are not permitted to use the Platform.

Geographic Eligibility

The Platform is intended for users located in jurisdictions where the use of such services is lawful. It is your sole responsibility to ensure that your use of the Platform does not violate the laws of the jurisdiction in which you reside or from which you access the Platform. Play Jump makes no representation that the Platform is appropriate for use in all locations.

Prohibited Users

• Individuals who have been previously suspended or banned from the Platform by Play Jump.
• Individuals acting on behalf of, or in association with, any entity engaged in fraudulent, illegal, or anti-competitive activities.
• Bots, automated systems, or non-human entities attempting to access or interact with the Platform.
• Competitors of Play Jump seeking to access the Platform for intelligence gathering or reverse-engineering purposes.

Account Registration

To access most Platform Services, you are required to create an Account. The following terms govern account creation and maintenance:

Registration Information

You agree to provide accurate, current, and complete information during the registration process, and to update such information as necessary to keep it accurate and complete at all times. Play Jump is not responsible for any loss or damage arising from your failure to maintain accurate account information.

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify Play Jump immediately at playjump933@gmail.com upon becoming aware of any unauthorised access to or use of your Account. Play Jump shall not be held liable for any loss or damage arising from your failure to protect your account credentials.

Account Ownership

• Each user may maintain only one Account. Creating multiple accounts is strictly prohibited and may result in permanent suspension of all associated accounts.
• Accounts are non-transferable. You may not sell, transfer, assign, or otherwise dispose of your Account or any rights therein to any third party.
• Play Jump reserves the right to reclaim or reassign usernames that are inactive, misleading, or in violation of these Terms.

KYC & Verification

Play Jump may, at its sole discretion, require users to complete a Know Your Customer (KYC) verification process before granting access to certain features or processing financial transactions. You agree to provide all documentation requested as part of the KYC process. Failure to complete KYC verification may result in restricted access to Platform features.

Platform Services

Play Jump offers a suite of IT platform services as an online entertainment and technology company. The following outlines the nature and scope of services provided:

Scope of Services

Play Jump provides online gaming and entertainment experiences, mobile entertainment applications, secure payment processing, cloud-based infrastructure, analytics, and business-to-business (B2B) partnership solutions. The exact features and services available to any individual user may vary based on their account type, geographic location, and applicable law.

Service Modifications

Play Jump reserves the right to modify, suspend, or discontinue any aspect of the Platform Services at any time, with or without notice, for any reason including maintenance, upgrades, legal compliance, or business reasons. Play Jump shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

Beta Features

From time to time, Play Jump may offer access to beta or experimental features. Such features are provided "as is" without any warranty, and Play Jump reserves the right to discontinue beta features at any time without notice or liability.

Third-Party Integrations

The Platform may integrate with or link to third-party services and platforms. Play Jump does not control such third-party services and accepts no responsibility for their availability, accuracy, or compliance with applicable laws. Your use of third-party services is governed solely by their respective terms and conditions.

User Conduct

By using the Platform, you agree to comply with all applicable laws and to conduct yourself in a manner that is lawful, respectful, and in accordance with the spirit of fair play. The following activities are expressly prohibited:

Prohibited Activities

• Using the Platform for any unlawful purpose or in a manner inconsistent with applicable local, state, national, or international law or regulation.
• Attempting to gain unauthorised access to any part of the Platform, its servers, databases, or networks connected to the Platform.
• Uploading, transmitting, or distributing any virus, malware, spyware, ransomware, or any other harmful or malicious code.
• Engaging in cheating, collusion, use of bots, exploiting software bugs or vulnerabilities, or any other activity that provides an unfair advantage in gameplay.
• Engaging in money laundering, fraud, or any other financial crime through the Platform.
• Harassing, abusing, threatening, defaming, or otherwise violating the legal rights of other users or Play Jump employees.
• Scraping, data-mining, or systematically extracting data from the Platform without express written permission from Play Jump.
• Impersonating any person or entity, or falsely claiming an affiliation with any person or entity.
• Attempting to reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code of any aspect of the Platform.
• Circumventing, disabling, or otherwise interfering with any security-related features of the Platform.

Fair Play Policy

Play Jump is committed to maintaining a fair and transparent gaming environment. All games and interactive experiences on the Platform are governed by a certified random number generation (RNG) system that ensures unbiased outcomes. Any attempt to manipulate or interfere with the RNG system constitutes a serious violation of these Terms and may result in immediate account termination and referral to law enforcement authorities.

Reporting Violations

If you become aware of any user engaging in prohibited activities, you are encouraged to report the matter to Play Jump at playjump933@gmail.com. Play Jump will investigate all reports in good faith and take appropriate action, which may include account suspension, permanent banning, and legal proceedings.

Payments & Transactions

All financial transactions conducted on the Platform are subject to the following terms. By initiating any transaction, you agree to these payment terms.

Payment Processing

Play Jump uses bank-grade encryption and secure payment gateways to process all financial transactions. Play Jump is GST-registered under GSTIN 09AAQCP4932P1ZH. Applicable taxes including Goods and Services Tax (GST) will be levied in accordance with Indian tax law. GST invoices will be issued where required by law.

Currency

All transactions are conducted in Indian Rupees (INR) unless otherwise specified. Play Jump is not responsible for any foreign exchange losses or banking fees incurred by users making payments in foreign currencies.

Deposits

• Deposits made into your Play Jump wallet are subject to minimum and maximum limits as displayed on the Platform.
• Deposits are typically processed within the timelines specified by the payment gateway used.
• Play Jump does not store complete payment card information; all card data is handled by our PCI-DSS compliant payment partners.

Withdrawals

• Withdrawal requests are subject to verification and may require submission of KYC documents before processing.
• Withdrawals will be processed within 3–7 business days, subject to the completion of any applicable verification requirements.
• Minimum withdrawal amounts and any applicable processing fees are displayed in the user's account settings.
• Play Jump reserves the right to withhold withdrawals where there is reasonable suspicion of fraudulent activity, violation of these Terms, or ongoing investigation.

Refund Policy

Refunds are issued at the sole discretion of Play Jump in accordance with our Refund Policy. Technical errors resulting in a transaction failure that debits a user's account will be investigated and, if confirmed, the amount will be reversed within a reasonable time. Play Jump does not offer refunds for completed in-platform purchases unless required by applicable consumer protection law.

Chargebacks

Initiating a chargeback without first attempting to resolve the matter with Play Jump's support team is considered a breach of these Terms. Play Jump reserves the right to suspend or permanently ban any account from which a chargeback is initiated and to pursue recovery of any amounts owed.

Intellectual Property

The Platform and all Content available on or through it are protected by intellectual property laws and are the exclusive property of Play Jump Private Limited or its licensors. Nothing in these Terms grants you any ownership right in the Platform or its Content.

Play Jump's Intellectual Property

All Content on the Platform, including but not limited to logos, trademarks, trade names, service marks, game designs, graphics, artwork, software, databases, code, and any other proprietary materials ("Play Jump IP"), is owned by or licensed to Play Jump and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian and international intellectual property laws.

The "Play Jump" name, the spinning atom logo, and all associated branding elements are trademarks of Play Jump Private Limited. Unauthorised use of any Play Jump IP is strictly prohibited and will be pursued to the fullest extent permitted by law.

Limited Licence to Users

Subject to your compliance with these Terms, Play Jump grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform solely for your personal, non-commercial entertainment purposes. This licence does not include the right to:

• Reproduce, distribute, publicly display, or create derivative works of any Play Jump IP without express written permission.
• Use the Platform or any Content for commercial purposes without a written partnership or licensing agreement with Play Jump.
• Use automated tools to extract, download, or aggregate Content from the Platform.
• Frame or mirror the Platform on any third-party website without Play Jump's express written consent.

User-Generated Content

To the extent you submit, post, or upload any Content to the Platform, you grant Play Jump a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, publish, translate, and distribute such Content in connection with operating and improving the Platform. You represent that you own all rights in such Content or have obtained all necessary permissions.

Privacy & Data Protection

Play Jump takes the privacy and security of your personal data seriously. The collection, use, storage, and disclosure of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the data practices described in our Privacy Policy.

Data Collection

We collect personal information such as your name, email address, mobile number, date of birth, government-issued identity documents (for KYC), payment information, device information, IP address, and usage data. This data is used to operate the Platform, process transactions, personalise your experience, improve our services, prevent fraud, and comply with legal obligations.

Data Storage & Security

All User Data is stored on secure servers located in India or other jurisdictions permitted under applicable data protection law. Play Jump employs industry-standard technical and organisational measures to protect your data against unauthorised access, alteration, disclosure, or destruction. However, no method of data transmission or storage is 100% secure, and Play Jump cannot guarantee absolute security.

Data Sharing

Play Jump does not sell your personal data to third parties. We may share your data with trusted service providers who assist us in operating the Platform, processing payments, or providing support services, under strict confidentiality obligations. We may also share data with regulatory authorities, law enforcement agencies, or courts when required by law.

Your Rights

Subject to applicable law, you have the right to access, correct, or delete your personal data held by Play Jump. You may exercise these rights by contacting us at playjump933@gmail.com. Please note that certain data may be retained for legal, compliance, or fraud-prevention purposes even after account deletion.

Cookies

The Platform uses cookies and similar tracking technologies to enhance user experience, analyse usage patterns, and deliver relevant content. By using the Platform, you consent to the use of cookies in accordance with our Cookie Policy. You may manage cookie preferences through your browser settings, though disabling cookies may affect Platform functionality.

Disclaimers & Warranties

The Platform and all Platform Services are provided on an "as is" and "as available" basis without warranty of any kind, express or implied, to the fullest extent permissible under applicable law.

Without limiting the foregoing, Play Jump does not warrant that:

• The Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
• The results obtained from using the Platform will be accurate, reliable, or meet your requirements.
• Any errors, defects, or malfunctions in the Platform will be corrected within any specific timeframe.
• Third-party content, links, or services accessible through the Platform are accurate, current, or lawful.

No Guarantee of Winnings

Play Jump does not guarantee any specific outcomes, winnings, or returns from participation in any gaming activities on the Platform. All gaming activities involve an element of skill, chance, or both. Past performance or outcomes are not indicative of future results.

Limitation of Liability

To the maximum extent permitted by applicable law, Play Jump Private Limited, its directors, officers, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

• Loss of profits, revenue, data, goodwill, or anticipated savings.
• Damages arising from your inability to access or use the Platform.
• Damages arising from unauthorised access to or alteration of your data.
• Damages arising from the conduct of any third party on the Platform.
• Any other matter relating to the Platform or Platform Services.

In no event shall Play Jump's total cumulative liability to you for all claims arising from or relating to these Terms or your use of the Platform exceed the greater of: (a) the total amount paid by you to Play Jump in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) INR 1,000 (Indian Rupees One Thousand Only).

The limitations set forth in this Section shall apply regardless of the form of the action, whether based in contract, tort (including negligence), strict liability, or otherwise, and even if Play Jump has been advised of the possibility of such damages.

Force Majeure

Play Jump shall not be held liable for any failure or delay in performance of its obligations under these Terms where such failure or delay results from a Force Majeure Event. Play Jump shall take all reasonable steps to minimise the impact of any Force Majeure Event and shall resume performance as soon as reasonably practicable.

Indemnification

You agree to defend, indemnify, and hold harmless Play Jump Private Limited and its directors, officers, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms or any applicable law or regulation.
• Your User Data or Content submitted to the Platform.
• Your use or misuse of the Platform or any Platform Services.
• Your violation of any third-party rights, including intellectual property rights, privacy rights, or contractual rights.
• Any fraudulent, negligent, or illegal activity by you or any person acting on your behalf.

Play Jump reserves the right to assume exclusive control over the defence of any matter for which you are required to indemnify us, in which case you agree to cooperate fully with our defence of such claim at your own expense.

Account Termination

These Terms and your right to access the Platform remain in effect until terminated by either party in accordance with this Section.

Termination by User

You may terminate your Account at any time by submitting a written request to Play Jump at playjump933@gmail.com. Account deletion requests will be processed within 30 days, subject to any pending transactions, disputes, or legal hold obligations. Any wallet balance at the time of account deletion will be refunded to your registered bank account, minus any applicable fees, after completion of applicable verification procedures.

Termination by Play Jump

Play Jump may, at its sole discretion, suspend or permanently terminate your Account at any time with or without notice, and without liability, for reasons including but not limited to:

• Violation of any provision of these Terms or any supplementary policy.
• Engaging in fraudulent, illegal, or abusive conduct on or through the Platform.
• Providing false or misleading information during registration or KYC.
• Engaging in activities that harm or threaten to harm Play Jump, its users, or third parties.
• Insolvency, bankruptcy, or other adverse financial circumstances affecting your ability to meet your obligations.
• Any legal or regulatory requirement compelling Play Jump to do so.

Effect of Termination

Upon termination, your right to access and use the Platform ceases immediately. All provisions of these Terms which by their nature should survive termination shall survive, including Sections relating to intellectual property, disclaimers, indemnification, limitation of liability, and governing law. Termination of your Account does not relieve you of any obligations or liabilities that accrued prior to termination.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of laws principles.

Jurisdiction

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction located in Noida, Uttar Pradesh, India. You hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection on grounds of inconvenient forum.

Arbitration

Notwithstanding the above, any dispute between you and Play Jump that cannot be resolved amicably within thirty (30) days of written notice may, at Play Jump's sole election, be referred to binding arbitration conducted under the Arbitration and Conciliation Act, 1996, as amended. The arbitration shall be conducted by a sole arbitrator appointed by Play Jump and shall be conducted in the English language in Noida, Uttar Pradesh. The arbitrator's decision shall be final and binding on both parties.

Class Action Waiver

To the extent permitted by applicable law, you waive your right to participate in any class action, collective, or representative proceeding against Play Jump. All claims must be brought on an individual basis.

Grievance Officer

In accordance with the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Play Jump has appointed a Grievance Officer to address user complaints and grievances.

All complaints and grievances shall be acknowledged within 48 hours of receipt and shall be resolved within a period of thirty (30) days from the date of receipt, subject to complexity and any ongoing investigations. Users are encouraged to provide all relevant details, supporting documents, and a clear description of their grievance when writing to the Grievance Officer.

Amendments & Updates

Play Jump reserves the right to modify, amend, or update these Terms at any time at its sole discretion. When material changes are made, we will notify users via email (to the registered email address on file), via an in-app notification, or by posting a prominent notice on the Platform.

The "Last Updated" date at the top of this document will be revised each time these Terms are modified. Your continued use of the Platform after the effective date of any modification constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Platform and, if applicable, submit a request to delete your account.

Play Jump encourages you to review these Terms periodically to stay informed of your rights and obligations. In the event of a conflict between a prior version and the current version of these Terms, the current version shall prevail in all respects.
